Introduction

This Hardware Warranty and Terms of Sale (“Terms”) is an agreement between you and Angler Labs, Inc. (“Anglr,” “we” or “us”) that applies to your purchase of Anglr trip-tracking devices (“Hardware”). If you have a separate, signed agreement with Anglr for purchasing Hardware, then these Terms do not apply to you for Hardware you purchase under that separate agreement.

Your use of Anglr products and services (“Anglr Services”) is governed by our Customer Terms of Use and our Privacy Policy, both of which are posted on our website. Any software that it embedded in Hardware is licensed to you, not sold. Additional terms relating to this type of software are included in the Customer Terms of Use.

Pricing

Our prices are listed in U.S. dollars, unless otherwise specified. Prices do not include taxes or shipping or similar costs, but the total amount shown at checkout will specify any taxes or shipping or similar costs. Shipments to countries outside of the U.S. may be subject to additional taxes, customs duties or other fees.We may change our prices at any time.

Ordering

By purchasing Hardware, you agree that the payment information you provide is complete and accurate and that you will pay the total amount listed at checkout, which includes the purchase price for the Hardware and any shipping or similar costs and any taxes specified at checkout. You represent and agree that you are purchasing hardware on behalf of yourself or another person in your household or as a gift, in each case for personal use and not for resale.

You acknowledge that we may use third party service providers to host our website, process payments and handle shipping. We must share certain information about you to these third parties in order to show you our products and services and to receive and fulfill your order. Please read our Privacy Policy for more information.

We reserve the right to reject any order and to set limits on purchases of Hardware by any customer or on orders with the same billing or shipping address. If we accept your order, we will inform you, either in a confirmation message or window on our website, or by email. We will also inform you of shipping information and other relevant details, including any inventory issues.

Fulfillment

We will use our standard packaging and shipping service to fulfill your order, although we may offer you shipping alternatives, some of which may cost more than standard shipping. All delivery dates are estimated and not guaranteed. We will not have any liability in connection with any delays in shipment or delivery. Title and risk of loss pass to you when we deliver the applicable Hardware to the shipping carrier.

Returns

If you are unsatisfied with Hardware you purchased from us, you may return it to us within thirty (30) days of the date of purchase for a full refund.

To do so, please contact us to receive return instructions. The Hardware must be undamaged, and the return must include the Hardware’s original packaging and all of the items that were included in the packaging when you bought the Hardware.

Please note that refund amounts will not include amounts you paid for shipping or taxes for which we can not get refunds ourselves.

Limited Warranty and Disclaimers

We warrant that Hardware will be free from defects in materials and workmanship under normal use in accordance with instructions and technical requirements provided with the Hardware (the “Warranty”).

The Warranty for any Hardware lasts for one (1) year from the date of purchase of the Hardware (the “Warranty Period”)The Warranty does not cover problems that may arise when the Hardware is used for a purpose other than the purpose for which it was designed, or when the Hardware is abused, or used in conditions outside the parameters specified in the documentation that comes with the Hardware. The Warranty also does not cover problems that arise from accidents or any failure to follow the directions that come with the Hardware, and it does not apply to any Hardware that has be modified or serviced by anyone other than Anglr or an Anglr-authorized service provider.

Some features of the Hardware work with other items you own, like your fishing rod and your mobile phone. Anglr is not responsible for any problems that may arise because of anything not provided by Anglr.

In some jurisdictions, certain warranty limitations are not allowed. Where that is the case, the applicable limitations above may not apply to you, but the remaining limitations will continue to apply.

To the extent permitted by applicable law, we disclaim all warranties other than the Warranty expressly stated above, including all implied warranties, such as the implied warranties of merchantability and fitness for a particular purpose. Where implied warranties cannot be disclaimed, then we make them only to the extent required by applicable law, and only for the duration of the Warranty expressly stated above or the minimum duration required by applicable law, whichever is shorter.

To the extent permitted by applicable law, we shall not be liable for any incidental, indirect, punitive, special or consequential damages, including any loss of data, profits or revenue, resulting from any breach of these Terms, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of such damages, so these exclusions and limitations may not apply to you.

Warranty Service

If you have a problem with Hardware that is covered by the Warranty and you submit a valid warranty claim during the Warranty Period, we will repair or replace the Hardware, at our option. Replacements may be new or refurbished, and will be covered by the Warranty for the part of the Warranty Period remaining for the original Hardware, or for the period of time that may be required by applicable law. To the extent permitted by applicable law, this is your sole remedy for Warranty claims.

To get Warranty service, please contact us, and we will tell you where to send the Hardware that needs service. You are responsible for packing the Hardware carefully, either in its original packaging or your own packaging, in order to avoid damage. We are not responsible for any data that may be stored on the Hardware.

Applicable Law

These Terms and your purchase of Hardware from us are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflicts-of-laws principles.Some jurisdictions provide certain consumer rights to their residents regardless of any exclusions, disclaimers or limitations contained in an agreement between the consumer and a vendor.
